1. Acceptance of Terms

By accessing or using GoldstreamAI LLC's website and services, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms apply to all visitors, users, and customers of GoldstreamAI.

2. Description of Services

GoldstreamAI provides AI-powered website design, hosting, and chatbot services for small businesses. Our services include:

  • Website creation: AI-generated websites based on your business information
  • Hosting: Ongoing website hosting on our infrastructure
  • AI chatbot: A conversational AI assistant embedded on your website
  • Maintenance: Regular updates, content changes, and technical support
  • Custom domain: Optional custom domain setup (Premium plan)

3. Accounts & Registration

To use our services, you must create an account. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these terms.

4. Free Demo Sites

GoldstreamAI offers free demo sites so you can evaluate our services before committing. Demo sites:

  • Are provided at no cost and with no obligation
  • Remain active for 30 days (soft expiry — site remains accessible but shows an upgrade prompt)
  • Are archived after 30 days of inactivity and permanently deleted after 90 days
  • Are hosted on a goldstreamai.com subdomain
  • May be upgraded to a paid subscription at any time to preserve your site

5. Subscriptions & Pricing

Essentials Plan — $99/month

  • Professional website with AI chatbot
  • Hosting & maintenance included
  • Same-day updates on request
  • Email support
  • One-time setup fee: $499

Premium Plan — $199/month

  • Your AI assistant — instant changes, no waiting
  • Content creation — blog posts, service pages, FAQs
  • Scheduled updates — set it and forget it
  • Proactive site monitoring
  • Priority phone & text support
  • One-time setup fee: $999

All prices are in USD. Setup fees are non-refundable. Monthly subscriptions are billed in advance on a recurring basis.

6. AI Agent Hosting

GoldstreamAI offers managed AI agent hosting. Your agent runs on our infrastructure and interacts with you through Telegram and the GoldstreamAI dashboard.

Managed Service

  • Your agent is hosted on infrastructure owned and operated by GoldstreamAI
  • You interact with your agent exclusively through Telegram and the GoldstreamAI dashboard
  • Access to underlying infrastructure, server configuration, and management tools is not provided to customers and remains under the sole control of GoldstreamAI
  • We handle all updates, maintenance, and security patches for the hosting infrastructure
  • We reserve the right to manage, maintain, and modify the hosting infrastructure without notice, provided the service continues to meet the specifications described in these terms

Service Tiers

  • Starter: Included AI model, 10,000 messages per month
  • Pro: Included AI model, unlimited messages
  • BYOK (Bring Your Own Key): You provide your own AI provider API key for unlimited usage — you are responsible for your relationship with that provider

Your Data & Privacy

  • Your agent can send files to your registered email address — it never reads or receives email
  • Messages between you and your agent are processed to provide the service but are not used for advertising
  • If you provide your own API key (BYOK), it is stored encrypted on our systems — we act as a conduit and do not use your key for any purpose other than running your agent
  • When you cancel, your agent is decommissioned and all data on the hosting infrastructure is permanently deleted

One-Time Setup Fee

Agent hosting requires a one-time setup fee of $99. This fee covers infrastructure provisioning and configuration. Setup fees are non-refundable once provisioning has begun.

7. Cancellation & Refunds

  • Monthly subscriptions can be cancelled at any time. Your site remains active through the end of the current billing period.
  • Setup fees are non-refundable once site development has begun.
  • Demo sites can be abandoned at any time with no charge.
  • We reserve the right to terminate service for accounts that violate these terms or engage in abusive behavior.

8. AI Disclaimer

Our services use artificial intelligence to generate website content and power chatbot interactions. Please note:

  • AI-generated content may occasionally be inaccurate, incomplete, or not reflect current information.
  • Chatbot responses are generated by AI and should not be considered professional, legal, medical, or financial advice.
  • You are responsible for reviewing and approving all content published on your site.
  • We do not guarantee that AI-generated content will be free from errors or biases.

GoldstreamAI is not liable for decisions made based on AI-generated content or chatbot interactions on customer sites.

9. Intellectual Property

Your content: You retain ownership of all business information, logos, images, and content you provide to us. By providing it, you grant us a license to use it solely for the purpose of providing our services.

Our platform: The GoldstreamAI platform, including its design, code, and underlying technology, is owned by GoldstreamAI LLC. You may not copy, modify, or redistribute any part of the platform.

AI-generated content: Content generated by our AI for your site is licensed to you for use within our hosted service. You may export or use such content elsewhere upon request.

10. Acceptable Use

You agree not to use our services to:

  • Violate any applicable law or regulation
  • Host, distribute, or promote illegal, harmful, or offensive content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the integrity or performance of our services
  • Use our chatbot to deceive, defraud, or harm others
  • Resell our services without authorization

11. Limitation of Liability

To the maximum extent permitted by law:

  • GoldstreamAI provides services “as is” without warranties of any kind, express or implied.
  • We are not liable for indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.
  • We are not responsible for data loss, business interruption, or loss of revenue resulting from service disruptions.

12. Indemnification

You agree to indemnify and hold harmless GoldstreamAI LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, your violation of these terms, or your violation of any rights of a third party.

13. Modifications

We may update these Terms of Service from time to time. We will provide notice of material changes by posting the updated terms on our website and updating the “Last updated” date. Continued use of our services after changes constitutes acceptance of the revised terms. If you do not agree with the changes, you may cancel your subscription.

14. Governing Law

These terms are governed by the laws of the State of Alaska, United States. Any disputes shall be resolved in the courts of Alaska.
